Locumedico Terms of Service

1. Introduction

Welcome to Locumedico, a healthcare staffing platform that connects qualified medical professionals with hospitals and healthcare facilities for locum tenens opportunities. These Terms of Service ("Terms") govern your access and use of the Locumedico website, mobile applications, and services.

By accessing or using the Locumedico platform or services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you are not authorized to use the Locumedico platform or services.

These Terms apply to all users of the platform, including medical professionals (doctors, specialists, and other healthcare providers), hospitals, healthcare facilities, and any other users accessing our services.

2. Definitions

  • "Locumedico" or "we" or "us" or "our" means the Locumedico Platform and its operators.
  • "Services" means the healthcare staffing and locum placement services provided by Locumedico, including but not limited to job matching, payment processing, KYC verification, communication tools, and related services.
  • "Platform" means the Locumedico website, mobile applications, and all related services and features.
  • "User" or "you" or "your" means any individual or organization that has registered for and is using the Locumedico Services.
  • "Medical Professional" or "Doctor" means a qualified medical professional (doctor, specialist, or other healthcare provider) registered on the platform seeking locum opportunities.
  • "Hospital" or "Healthcare Facility" means a hospital, clinic, nursing home, or other healthcare institution registered on the platform seeking medical staff.
  • "Job" or "Opportunity" means a locum tenens position posted by a Hospital on the platform.
  • "Placement" means a successful match between a Medical Professional and a Hospital for a locum position.

3. Account Registration

To use the Locumedico Services, you must register for an account. During the registration process, you will be required to provide certain information about yourself and/or your organization. You agree to provide accurate, current, and complete information, and to update such information as necessary to maintain its accuracy and completeness.

Each account must be associated with a unique individual or organization. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

3.1 Account Requirements

  • For Medical Professionals: You must be at least 18 years of age, hold valid medical qualifications (MBBS, MD, MS, DNB, or equivalent), possess a valid medical license from a recognized medical council (MCI/State Medical Council), and have the legal right to work in India.
  • For Hospitals: You must be a legally registered healthcare facility, have authorization to hire medical staff, and provide accurate facility and contact information.
  • Password Requirements: Your password must be at least 8 characters long, contain uppercase and lowercase letters, numbers, and special characters. You are solely responsible for maintaining the security of your password.

3.2 Account Security

You agree to (a) immediately notify Locumedico of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Locumedico will not be liable for any loss or damage arising from your failure to comply with this Section.

4. Use of Services

Locumedico grants you a limited, non-exclusive, non-transferable license to access and use the Services for the purpose of finding locum opportunities (for Medical Professionals) or hiring medical staff (for Hospitals). You agree to use the Services in accordance with these Terms and any applicable laws and regulations.

You further agree that you will not:

  • Use the Services for any unlawful or unauthorized purpose, including but not limited to discrimination based on race, color, national origin, religion, age, sex, sexual orientation, or disability.
  • Provide false, misleading, or inaccurate information about your qualifications, credentials, or identity.
  • Attempt to gain unauthorized access to Locumedico's systems or networks.
  • Interfere with or disrupt the integrity or performance of the Services or other users' use of the Services.
  • Copy, modify, or create derivative works of the Services or any part thereof.
  • Reverse engineer, decompile, or disassemble any software or technology used in the Services.
  • Extract, mine, or "scrape" data or content from the Services without authorization.
  • Use the Services to circumvent payment processing or engage in any fraudulent activity.
  • Contact other users outside of the platform to avoid platform fees or bypass our services.
  • Post jobs or apply for positions that violate applicable healthcare regulations or laws.

5. User Obligations & Responsibilities

5.1 Medical Professional Obligations

  • Provide accurate and complete information about your qualifications, experience, and credentials.
  • Maintain valid medical licenses and registrations required to practice medicine.
  • Fulfill your commitments to Hospitals once you accept a locum position.
  • Comply with all applicable healthcare regulations, medical ethics, and professional standards.
  • Maintain patient confidentiality and follow all privacy and data protection requirements.
  • Respond promptly to job applications and communications from Hospitals.

5.2 Hospital Obligations

  • Provide accurate information about your facility, job requirements, and working conditions.
  • Comply with all applicable employment laws, healthcare regulations, and labor standards.
  • Pay Medical Professionals in accordance with agreed terms and platform payment policies.
  • Provide a safe working environment and necessary resources for Medical Professionals.
  • Respect the terms of placement agreements and not engage in discriminatory hiring practices.
  • Respond promptly to applications and communications from Medical Professionals.

5.3 Compliance with Laws

You will comply with all applicable laws, rules, and regulations in your use of the Services, including but not limited to laws related to healthcare, employment, data privacy, medical practice, and non-discrimination.

6. Verification and KYC

Locumedico requires verification of identity and credentials for all users to ensure platform safety and compliance:

  • Medical Professionals: Must provide valid medical licenses, educational certificates, identity documents, and complete KYC verification as required.
  • Hospitals: Must provide facility registration documents, authorization letters, and business verification documents.
  • Locumedico reserves the right to verify, reject, or suspend accounts that do not meet verification requirements or provide inaccurate information.
  • Verification is an ongoing process, and users must update their information when licenses, registrations, or credentials expire or change.

7. Payments and Fees

7.1 Payment Processing

Locumedico facilitates payments between Hospitals and Medical Professionals through secure payment gateways. Payments may be processed via UPI, debit cards, credit cards, or bank transfers as available on the platform.

7.2 Escrow Protection

For certain placements, payments may be held in escrow until the completion of services to protect both parties. Escrow terms will be clearly communicated at the time of placement.

7.3 Platform Fees

Locumedico may charge platform fees for certain services, which will be clearly disclosed before you use such services. Fees are subject to change with prior notice.

7.4 Refunds

Refund policies will be determined on a case-by-case basis in accordance with our refund policy and applicable laws. Contact support for refund requests.

8. Communication and Privacy

Locumedico provides communication tools including masked calling and messaging features to protect user privacy:

  • Users must not share personal contact information (phone numbers, email addresses) outside the platform until a placement is confirmed.
  • All communications should be professional and respectful. Harassment, abuse, or inappropriate behavior will not be tolerated.
  • Locumedico may monitor communications for safety, security, and quality assurance purposes.
  • User privacy is protected in accordance with our Privacy Policy.

9. Intellectual Property

The Services, including all content, features, functionality, and technology, are owned by Locumedico and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works of any content from the Services without our prior written consent.

You retain ownership of any content you post on the platform, but you grant Locumedico a license to use, display, and distribute such content in connection with providing the Services.

10. Termination and Suspension

Locumedico reserves the right to terminate or suspend your account and access to the Services at any time, with or without cause, and with or without notice, if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect the platform and its users.

You may terminate your account at any time in the Locumedico app (Profile → Delete account) or by contacting Locumedico support. Upon termination of your account, you will no longer have access to the Services, and any data associated with your account may be deleted in accordance with our Privacy Policy. Locumedico is not responsible for any loss of data or information resulting from the termination of your account.

11. Disclaimers

Locumedico provides the Services on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, materials, or products included in the Services. You expressly agree that your use of the Services is at your sole risk.

Locumedico does not guarantee:

  • That the Services will be uninterrupted, secure, or error-free.
  • The accuracy, completeness, or reliability of any user information or content.
  • That placements will be successful or that users will fulfill their obligations.
  • The quality, safety, or legality of jobs posted or services provided by users.

Locumedico is a platform that facilitates connections between Medical Professionals and Hospitals. We are not a party to any employment relationship, and we do not guarantee employment or placements. Any employment relationship is solely between the Medical Professional and the Hospital.

12. Limitation of Liability

In no event shall Locumedico or its directors, officers, employees, or agents be liable to you or any third party for any indirect, incidental, special, punitive, or consequential damages whatsoever arising out of or in connection with these Terms or your use of the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory.

Locumedico's total liability to you for all damages (other than as may be required by applicable law) shall not exceed the amount of fees you have paid to Locumedico in the six (6) months preceding the event giving rise to the liability, or INR 10,000, whichever is less.

Locumedico is not liable for any disputes, claims, or issues arising between Medical Professionals and Hospitals, including but not limited to payment disputes, employment disputes, or professional misconduct. Users are responsible for resolving such disputes directly or through appropriate legal channels.

13. Indemnification

You agree to indemnify, defend, and hold harmless Locumedico and its directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you post or transmit through the Services.

14. Changes to Terms

Locumedico reserves the right to modify or update these Terms at any time, with or without notice. Any changes to these Terms will be effective immediately upon posting on the Locumedico platform. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

15. Governing Law and Jurisdiction

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in India, and you hereby consent to the personal jurisdiction of such courts.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Locumedico with respect to the subject matter hereof, and supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms shall remain in full force and effect.

16.3 Waiver

The failure of Locumedico to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.

16.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Locumedico. Locumedico may assign or transfer its rights and obligations under these Terms without your consent.

16.5 Force Majeure

Locumedico shall not be liable for any failure or delay in the performance of its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, labor disputes, embargoes, government orders, pandemics, or any other force majeure event.

18. Acceptance of Terms
